This Privacy Policy explains how Ohanafy, Inc. (“Ohanafy,” “we,” “us,” or “our”) collects, uses, and shares personal information, and how you can exercise your privacy rights.

1. Scope and updates to this Privacy Policy

This Privacy Policy applies to personal information we process across our websites, marketing pages, events, sales activities, and any other online or offline interactions we have with you. Together, these are referred to as the “Services” throughout this policy.

Changes to this Privacy Policy. We may update this Privacy Policy from time to time. If we make material changes, we will provide notice as required by applicable law. Your continued use of the Services after an updated Privacy Policy takes effect means you accept the updated version.

Important note on Customer Data. Ohanafy provides software to beverage distributors, wholesalers, suppliers, and retailers. When our customers use our products, they may upload, store, or process personal information about their own employees, customers, retail accounts, or business contacts (collectively, “Customer Data”). This Privacy Policy does not govern our processing of Customer Data. Our processing of Customer Data is governed by the agreements we sign with each customer, including our Data Processing Addendum. If you are an end user, employee, or contact of one of our customers and have a question about Customer Data, please reach out to the Ohanafy customer that controls your data.

2. Personal information we collect

The categories of personal information we collect depend on how you interact with us. We collect information you give us directly, information collected automatically when you interact with the Services, and information from third-party sources.

A. Information you provide

We may collect the following categories of information that you provide to us:

  • Contact and account information. Your name, business email address, phone number, company name, job title, and any other information you submit when creating an account, requesting a demo, downloading content, or registering for an event.
  • Information you submit in inquiries. Personal information you include when contacting sales, customer support, or any other Ohanafy team, including the contents of your message.
  • Event and form submissions. Information you provide when registering for webinars, conferences, trade shows (such as NBWA, CBC, or WSWA), or other Ohanafy events.
  • Sales and procurement information. Information shared during sales conversations, contract negotiations, security reviews, or procurement processes, which may include details about your role and your organization.
  • Job applicant information. If you apply for a role at Ohanafy, we collect the information you submit through our hiring process, including your resume, cover letter, work history, and any other information you choose to share. Some of this information may be sensitive.
  • AI agent interactions. If you interact with a demonstration or marketing AI agent that we operate, we may collect what you enter into that interaction, including any personal information you choose to include.
  • Survey and feedback responses. Information you provide when you participate in customer research, surveys, or feedback requests.
  • Customer reference and case study information. If you participate in a case study, testimonial, or customer reference, we collect the information you provide in that context.

B. Information collected automatically

When you interact with our Services, we may automatically collect:

  • IP address and approximate location derived from it
  • Device and browser information, including operating system, browser type and version, screen resolution, and language settings
  • Usage information, including pages visited, time spent on pages, links clicked, referring and exit URLs, and the date and time of your visit
  • Mobile device identifiers, where applicable
  • Information collected through cookies, pixels, and similar technologies (see Section 2.D below)

C. Information from other sources

We may receive information about you from third-party sources, including:

  • Business data providers such as ZoomInfo, Apollo, Clay, LinkedIn Sales Navigator, and similar services that aggregate professional contact information
  • Public sources such as your company’s website, your professional social media profiles, NBWA member directories, and industry publications
  • Joint marketing partners with whom we may co-host events, webinars, or content, who may share registration information with us
  • Referrals from existing customers, partners, or other contacts in our network

D. Cookies and similar technologies

We and our service providers use cookies, pixel tags, web beacons, and similar tracking technologies on our websites. These technologies serve several purposes:

  • Strictly necessary. Required for our websites to function, such as cookies that remember your privacy preferences or keep you logged into a portal. These cannot be disabled without breaking core functionality.
  • Functional. Improve your experience by remembering your preferences and settings.
  • Analytics and performance. Help us understand how visitors use our websites so we can improve them. We use Google Analytics for this purpose. You can opt out of Google Analytics by installing the Google Analytics opt-out browser add-on.
  • Marketing and advertising. Help us deliver advertising that is relevant to you on third-party platforms (such as LinkedIn, Google, and Meta) and measure the effectiveness of our campaigns.

You can manage your cookie preferences through the cookie banner on our website or through your browser settings. Blocking certain cookies may affect website functionality.

Do Not Track. Our websites do not currently respond to Do Not Track signals.

Global Privacy Control. We honor the Global Privacy Control (GPC) signal as an opt-out of the “sale” and “sharing” of personal information for users where applicable law gives them that right. For more information about the GPC, visit globalprivacycontrol.org.

3. How we use personal information

We use the personal information we collect for the following business purposes:

A. To deliver our Services

  • Create and manage your account or contact record
  • Respond to your requests for information, demos, content, or support
  • Provide access to our websites, marketing content, and event platforms
  • Communicate with you about your account, your inquiries, and updates to our Services or policies
  • Process and follow up on event registrations

B. For business operations

  • Conduct sales and account management activities
  • Send invoices and process payments (through third-party payment processors)
  • Run security monitoring, fraud prevention, and abuse detection
  • Debug, audit, and improve our Services
  • Train and improve our internal teams, including through call review and analysis
  • Comply with legal, regulatory, and contractual obligations
  • Enforce our agreements and protect our legal rights
  • Conduct research, analytics, and product development
  • Evaluate and pursue business opportunities, including partnerships and corporate transactions
  • Evaluate job applications and manage our hiring process

C. For marketing and advertising

We may use personal information to:

  • Send marketing communications about our products, events, content, and industry insights (you can opt out at any time)
  • Deliver targeted advertising on third-party platforms based on hashed or de-identified data
  • Personalize the content you see on our websites
  • Measure the effectiveness of our marketing campaigns
  • Invite you to participate in customer research, case studies, or community programs

You can opt out of marketing emails using the unsubscribe link in any marketing email or by contacting us at privacy@ohanafy.com. You will continue to receive transactional and operational messages related to your account, contracts, or support requests.

D. With your consent

We may use personal information for purposes that we disclose to you and for which we obtain your consent.

E. Other permitted purposes

We may use personal information for any other purpose disclosed to you at the time of collection or otherwise permitted by applicable law.

De-identified and aggregated information. We may de-identify or aggregate personal information so that it can no longer be reasonably linked to an individual. We may use, share, and retain de-identified and aggregated information for any lawful purpose, including research, analytics, benchmarking, and product development.

4. How we disclose personal information

We share personal information with the following categories of recipients:

A. Service providers

We share personal information with service providers and vendors that help us operate our business, such as:

  • Platform and infrastructure. Salesforce (our underlying platform), Amazon Web Services, and similar cloud hosting providers
  • CRM and marketing. HubSpot, Salesforce Marketing Cloud, and other tools we use to manage marketing and sales communications
  • Analytics and product telemetry. Google Analytics and similar tools
  • Customer support and communications. Tools we use to respond to inbound inquiries and operate our help and support channels
  • Payment processing. Third-party payment processors handle any payment card information you provide
  • Event platforms. Tools we use to host webinars, register attendees, and manage in-person events
  • AI service providers. Third parties that provide generative AI or other AI capabilities we use to operate our business and Services

A current list of sub-processors that handle Customer Data is maintained separately and provided to customers under our Data Processing Addendum.

B. Business partners

We may share personal information with partners with whom we co-market, co-host events, or co-deliver services, where you have engaged with that joint offering.

C. Affiliates

We may share personal information with our corporate affiliates for the purposes described in this Privacy Policy.

D. Advertising partners

We may share limited information with advertising partners (such as LinkedIn, Google, and Meta) to deliver and measure marketing campaigns. Where required by law, we obtain your consent for these activities.

E. Legal and safety disclosures

We may disclose personal information when we believe in good faith that disclosure is necessary to:

  • Comply with applicable law, legal process, court orders, or government requests
  • Enforce our agreements or policies
  • Protect the rights, property, or safety of Ohanafy, our customers, our employees, or others
  • Investigate, prevent, or address fraud, security incidents, or illegal activity
  • Collect amounts owed to us

F. Business transactions

If we are involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, personal information may be transferred as part of that transaction, subject to applicable law.

We may also disclose personal information with your consent or as otherwise permitted by law.

5. Your privacy choices and rights

A. Your choices

  • Marketing email. Click the unsubscribe link at the bottom of any marketing email, or contact us at privacy@ohanafy.com. You will continue to receive transactional messages.
  • Marketing calls. If you receive a marketing call from us that you do not want, you can let the caller know or contact us.
  • Cookies. Manage cookie preferences through the cookie banner on our websites or your browser settings.
  • Targeted advertising opt-outs. Use the Network Advertising Initiative opt-out, the Digital Advertising Alliance opt-out, or your platform-specific ad preferences (for example, LinkedIn or Google Ad Settings).

B. Your rights

Depending on where you live, you may have the right to:

  • Know and access. Request information about the personal information we hold about you, including the categories of information, the sources, the purposes for processing, and the categories of third parties with whom we share it. You may also request a copy of your personal information.
  • Correct. Request that we correct inaccurate or incomplete personal information.
  • Delete. Request that we delete personal information we hold about you.
  • Port. Request a copy of your personal information in a portable format.
  • Opt out. Opt out of certain processing activities, including targeted advertising and any activity that may qualify as a “sale” or “sharing” of personal information under your local law.
  • Restrict or object. Restrict or object to certain processing of your personal information.
  • Withdraw consent. Withdraw consent for processing that is based on consent. Withdrawal does not affect the lawfulness of processing before the withdrawal.
  • Appeal. Appeal our decision regarding a privacy request.
  • Non-discrimination. Not be discriminated against for exercising your rights.

To exercise these rights, email us at privacy@ohanafy.com. We may need to verify your identity before processing your request. You can also designate an authorized agent to act on your behalf, subject to verification requirements.

If your personal information is subject to EU, UK, or Swiss data protection law and you believe we have not handled your information appropriately, you have the right to lodge a complaint with your local supervisory authority:

  • European Data Protection Authorities
  • UK Information Commissioner’s Office
  • Swiss Federal Data Protection and Information Commissioner

6. Notice to California residents

This section applies to personal information we collect about California residents and is provided under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”).

A. Categories of personal information collected

In the past 12 months, we may have collected the following categories of personal information from California residents:

  • Identifiers such as name, email address, phone number, IP address, and online identifiers
  • Customer records information such as business contact information and professional details
  • Commercial information such as records of products purchased or considered
  • Internet activity such as browsing history on our websites, search history, and interactions with content
  • Geolocation data such as approximate location derived from IP address
  • Professional or employment-related information such as job title, company, and information from job applications
  • Inferences drawn from any of the above to create a profile reflecting preferences or behavior
  • Sensitive personal information in limited cases, such as account login credentials or information voluntarily provided in job applications

B. Sources

We collect this information directly from you, automatically through your use of our Services, and from third-party sources as described in Section 2.

C. Purposes

We use this information for the business and commercial purposes described in Section 3.

D. Disclosure

We disclose these categories of personal information for the business purposes described in Section 4 to the categories of recipients listed in that section, including service providers, business partners, affiliates, advertising partners, and others.

E. Sale and sharing

Under the CCPA, the use of certain advertising and analytics technologies may be considered a “sale” or “sharing” of personal information. We may “sell” or “share” the following categories: identifiers, internet activity, and inferences, for the purpose of delivering targeted advertising. California residents have the right to opt out of this activity by using the cookie banner on our websites or by enabling the Global Privacy Control signal in their browser.

We do not knowingly sell or share the personal information of California residents under the age of 16.

F. Sensitive personal information

We use and disclose sensitive personal information only for purposes permitted under the CCPA and do not use it for purposes that would require an opt-out right under California law.

G. Retention

We retain personal information as described in Section 8.

H. Non-discrimination

We will not discriminate against you for exercising your CCPA rights.

7. International transfers of personal information

Ohanafy is headquartered in the United States and processes personal information in the United States. If you access our Services from outside the United States, your personal information may be transferred to, stored, and processed in the United States or other countries that may have different data protection laws than your home country.

When we transfer personal information from the European Economic Area, United Kingdom, or Switzerland to a country that has not received an adequacy decision under applicable law, we use safeguards such as the European Commission’s Standard Contractual Clauses and the UK International Data Transfer Addendum.

8. Retention of personal information

We retain personal information for as long as needed to fulfill the purposes for which it was collected, including providing the Services, complying with legal obligations, resolving disputes, and enforcing our agreements. To determine the appropriate retention period, we consider the amount and sensitivity of the information, the purposes for processing, the risks of harm from unauthorized use or disclosure, and applicable legal requirements.

When we no longer need to retain personal information, we will delete, anonymize, or otherwise dispose of it in accordance with our retention practices.

9. Our legal basis for processing (EEA, UK, Switzerland)

If you are in the European Economic Area, the United Kingdom, or Switzerland, our legal bases for processing your personal information are:

  • Performance of a contract. We process your personal information when it is necessary to perform a contract with you or to take steps at your request before entering a contract.
  • Legitimate interests. We process your personal information for our legitimate interests, including operating and improving our Services, conducting business development and marketing activities, ensuring the security of our Services, and other purposes described in this Privacy Policy. We balance our legitimate interests against your rights and freedoms.
  • Legal obligation. We process your personal information when required to comply with a legal obligation, such as tax, accounting, or regulatory requirements.
  • Consent. Where required by law, we rely on your consent. You may withdraw your consent at any time.

10. Children’s information

Our Services are not directed to children under the age of 18, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us at privacy@ohanafy.com and we will take appropriate steps to delete the information, unless we have a legal obligation to retain it.

11. Other provisions

Third-party links. Our Services may contain links to third-party websites, services, or applications that are not operated by us. We are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party service before providing your information.

Security. We use reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Data controller. For purposes of EU, UK, and Swiss data protection law, Ohanafy, Inc. is the data controller of personal information processed under this Privacy Policy.
